TERMS & CONDITIONS
By purchasing, enrolling in, subscribing to, or participating in any program, product or service provided by Ross Dominic Health Ltd, trading as The Comfort Eating Solution™ (“the Company”), you acknowledge that you have read, understood and agreed to these Terms and Conditions. Your enrolment constitutes a legally binding agreement between you and the Company. The Company reserves the right to amend these Terms and Conditions from time to time, and any updated version will supersede previous versions.
Free Trials
If participating in a free trial for a stated period, your payment method will be charged automatically on the day following the end of the trial period unless you cancel before the trial expires. Any payments made after the free trial period are non-refundable except where a specific refund policy or money-back guarantee is expressly stated at the time of purchase.
Fees & Payments
The investment required to participate in a program, product or service is the price displayed at the time of purchase, including any promotional discounts that may apply. You authorise the Company and its payment providers to charge your selected payment method for the agreed amount.
Where an instalment or payment plan is selected, you authorise the Company to collect each scheduled payment using your nominated payment method.
All currency conversion fees, bank charges, payment processing fees or similar charges imposed by your financial institution remain your responsibility.
Participants who purchase using an instalment or payment plan remain responsible for the full purchase price of the program. An instalment plan is a method of payment only and is not a monthly subscription or pay-as-you-go arrangement. By enrolling, you agree to complete all scheduled instalment payments unless otherwise required by applicable law.
Program Access & Private Appointments
Your enrolment includes access to the products, services, program materials, audio sessions, videos, downloads, support, bonuses and other resources described at the time of purchase.
Where a program includes private one-to-one appointments, those appointments must take place within the stated duration of the program. Any appointments not used within that period will expire and cannot be carried forward, exchanged for cash, credit, refunds or alternative services.
For programs purchased using an instalment or payment plan, the first private appointment may be booked immediately following enrolment. The second private appointment may only be booked once the second scheduled instalment has been successfully received. If any scheduled payment is missed, cancelled, reversed or otherwise remains outstanding, the Company reserves the right to postpone, suspend or cancel future appointments and access to program benefits until the account has been brought fully up to date.
Where a program includes coaching calls, consultations, discounted services, bonus resources, support access or other participant benefits, these must also be used during the active program period unless otherwise stated. Unused sessions, discounts, bonuses, support access or participant benefits expire at the end of the stated program duration and cannot be exchanged for cash, credit, refunds or alternative services.
The Company reserves the right to suspend or terminate access to digital content, support or other program benefits where scheduled payments remain outstanding.
Refund Policy
Unless a specific money-back guarantee or refund policy is clearly stated at the time of purchase, all payments are non-refundable. This applies whether the program is purchased for yourself or as a gift for another person.
By enrolling, you acknowledge that access to digital content, program materials and other resources may be provided immediately following purchase. Failure to complete the program, access the materials, attend appointments, use available support, or achieve a desired outcome does not entitle a participant to a refund.
Participant Conduct
The Company is committed to providing a positive experience for all participants. The Company reserves the right, at its sole discretion, to suspend, restrict or terminate participation or access without refund where a participant engages in abusive, disruptive, unlawful, inappropriate or harmful conduct, or where their behaviour materially interferes with the operation of the program or the experience of other participants.
Intellectual Property
All program materials, hypnosis audio sessions, videos, downloads, documents, worksheets, branding, trademarks, logos and other content provided by the Company remain the intellectual property of Ross Dominic Health Ltd and are protected by applicable copyright and intellectual property laws.
Program materials are licensed for personal use only.
You may not copy, reproduce, distribute, sell, share, republish, modify, record, transmit, publicly display, commercially exploit or otherwise make available any program materials to any third party without the Company’s prior written permission.
Confidentiality
Where participants communicate with one another through program-related groups, communities, discussions or support channels, participants agree to respect the privacy and confidentiality of other participants and not disclose personal or confidential information shared within those environments.
Disclaimer
The Comfort Eating Solution™ and all related programs, products and services are educational and behavioural change resources designed to support personal development and positive change.
Individual results will vary and depend upon many factors including personal circumstances, consistency, participation, willingness to apply the material and actions taken outside of the program.
No guarantee is made regarding specific weight loss outcomes, behavioural changes, health improvements or any other particular result. The program itself does not create results. Results arise from the participant’s engagement with, and application of, the material provided.
By enrolling, you accept full responsibility for your participation, decisions, actions and outcomes.
The Company does not provide medical diagnosis or medical treatment. Participants should continue to seek advice from their own GP or healthcare professional regarding any medical condition, medication or treatment.
Limitation of Liability
To the fullest extent permitted by law, Ross Dominic Health Ltd shall not be liable for any indirect, incidental, consequential, special or punitive damages arising from participation in any program, product or service.
Any liability, where established, shall be limited to the amount actually paid by the participant for the specific program, product or service giving rise to the claim.
Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Ireland.
Any disputes arising from participation in any program, product or service shall be subject to the exclusive jurisdiction of the Irish courts.
